Terms of Service

These terms apply when you use Ground Intel (the “Service”), the website and web application at groundintel.ie. The Service is operated by KHO Consulting Limited, a company registered in Ireland (company no. 798040) (“we”, “us”). By using the Service you agree to these terms. If you use it on behalf of an organisation, you confirm you can accept them for that organisation.

1. What the Service does

Ground Intel gathers publicly available geological, hydrogeological, environmental and ecological data for a location, route or area you choose, and applies a set of documented rules to produce a preliminary desk study, including a geohazard register, a suggested ground investigation scope, a bill of quantities, a cost estimate and a specification. The Service is intended for use by engineers, geologists and other professionals in the course of their work.

2. Outputs are not professional advice

Everything the Service produces is a starting point for a desk study, not a substitute for one prepared and checked by a competent, suitably qualified person. In particular:

  • Source datasets are published at regional scales, may be incomplete, out of date or inaccurate, and may not reflect conditions at a specific site.
  • Interpretations, hazard ratings, ground investigation suggestions, quantities, specification clauses and cost estimates are generated by fixed rules and default rates. They do not take account of anything the Service does not know about your project or site.
  • You are responsible for checking outputs against the original sources and site-specific information, for any decisions you make, and for any reports you issue. Any report based on the Service should be reviewed and approved by a competent person before anyone relies on it.

3. Third-party data

Data shown in the Service comes from organisations including Geological Survey Ireland, the Environmental Protection Agency, the National Parks and Wildlife Service, the Geological Survey of Northern Ireland, the Office of Public Works, Teagasc, the National Biodiversity Data Centre and OpenStreetMap contributors. It remains theirs and is used under the licences they publish. We do not control it and cannot guarantee it is available, complete or correct. If you reuse outputs, keep the source attributions that come with them.

4. Your account and acceptable use

Where you create an account, keep your sign-in details secure and give accurate information. You are responsible for activity under your account. You must not:

  • use the Service unlawfully or to infringe anyone’s rights;
  • scrape, bulk-download or run automated queries against the Service, or use it to rebuild the underlying datasets;
  • try to break, overload or get around the Service’s security or usage limits;
  • copy, decompile or reverse engineer the Service, except where the law allows it.

We may suspend or close access that breaks these terms or puts the Service or other users at risk.

5. Your content

Projects, site geometry, reports and other content you create or upload remain yours. You give us permission to store and process it only as needed to run the Service for you. How we handle personal data is set out in our Privacy Policy.

6. Our intellectual property

The Service, including its software, design, rule base and text we write, belongs to us or our licensors. You may use reports generated for your projects in your work, including sharing them with clients.

7. Availability and changes

The Service depends on third-party data services that can change or go offline without notice. We provide it “as is” and do not promise it will be uninterrupted or error-free. The Service is currently free. We may change, add or remove features, or introduce paid plans; we will give reasonable notice before charging for anything you already use.

8. Liability

To the extent the law allows:

  • we are not liable for any loss arising from reliance on outputs of the Service that have not been independently checked by a competent person;
  • we are not liable for indirect or consequential loss, or for loss of profit, revenue, contracts, business or data;
  • our total liability to you in connection with the Service is limited to the greater of the amount you paid us in the 12 months before the claim and €100.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

9. Ending use

You can stop using the Service at any time and ask us to delete your account by emailing us. We may end the Service or your access on reasonable notice, or immediately for a serious breach of these terms.

10. Changes to these terms

We may update these terms. We will post the new version here with a new date, and tell account holders about significant changes before they take effect.

11. Law

These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction.
